Mr.Shashi Kant Shandilya, learned counsel for the Applicant.

2. Mr. G.C. Joshi, learned A.G.A. for the State of Uttarakhand.

3. The present Bail Application has been moved by the Applicant - Anas, aged about 22 years, S/o Shri Muneef Ahmad, R/o Jasodharpur, P.S. Kotwali, Laksar, District Haridwar. The Applicant is in judicial custody in connection with Case Crime No. 616 of 2025, registered at Police Station Pathri, District Haridwar, under Sections 8(c)/21(b)/60 of the NDPS Act, 1985.

4. Heard Mr. Shashi Kant Shandilya, learned counsel for the Applicant, and Mr. G.C. Joshi, learned A.G.A. for the State. Perused the record.

5. Learned counsel for the Applicant submits that the incident narrated in the FIR is totally false and fabricated at the instance of the police officials and that no such recovery was made from the Applicant. It is further submitted that the Applicant is languishing in jail since 14.11.2025; that he is a student of B.Sc. Nursing and his entire career will be at stake; that the provisions of Section 50 of the NDPS Act have not been complied with; and that neither any eye- witness nor any independent witness of the alleged incident has been shown by the prosecution.

6. Learned State Counsel has opposed the Bail Application.

7. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the matter, this Court is of the view that the Applicant is entitled to be released on bail at this stage.

8. Accordingly, the Bail Application is allowed.

9. Let the Applicant be released on bail upon his executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the Court concerned.

10. All pending applications, if any, stand disposed of.
