2. This first bail application has been moved by the applicant seeking regular bail in F.I.R. No.21 of 2025, under Section 109(1), 191(2), 191(3), 351(3), 352, 3(5) of B.N.S., 2023 and Section 4/25 of the Arms Act, registered at Police Station Joshimath, District Chamoli.

3. The First Information Report was registered against eight persons, including the applicants, under the aforementioned sections. Following investigation, a charge-sheet has been filed against all accused.

4. Learned counsel for the applicants submits that co-accused have been granted bail by the learned trial Court. However, the applicants' bail applications were rejected on account of specific allegations in the F.I.R. attributing the use of sword and axe to them. He contends that the prosecution version is entirely fabricated; in truth, the applicants were assaulted by local residents while returning from Hemkund Sahib. Notably, there are no injuries on the persons of Deepak and Mahavir. The applicants have been in judicial custody since 30.06.2025, enjoy clean criminal antecedents, and belong to the Nihang Sikh community, having dedicated their 2026:UHC:1419

lives to Sikh religious service. Learned counsel assures this Court that, if released on bail, the applicants shall not misuse the liberty granted, will fully cooperate in the trial, and will furnish bail bonds and sureties to the satisfaction of this Court.

5. Learned counsel for the State has vehemently opposed the prayer for bail.

6. In light of the foregoing, particularly the absence of injuries on the alleged victims named in the F.I.R., the applicants' prolonged incarceration since 30.06.2025, and their unblemished criminal record, this Court, without commenting on the merits of the case, is inclined to enlarge the applicants on bail at this stage.

7. The bail application is allowed.

8. Let the applicants, namely, Harpreet Singh and Harjot Singh be released on bail, on executing personal bond by each one of them and furnishing two reliable sureties by each one of them, each of like amount, to the satisfaction of Court concerned.
