Mr. I.P. Kohli, Advocate for the appellant. Ms. Tanushree Pande, Advocate for the respondents appeared through video conferencing.

The challenge in this appeal is made to the judgment and award dated 13.02.2025, passed in MACP Case No.67 of 2022, Smt. Uma Pandey and others Vs. Himanshu Kirola and another, by the court of Motor Accident Claim Tribunal/First Additional District Judge, Haldwani, District Nainital. On 14.05.2025, when the matter was admitted, the Court was required the appellant to deposit the amount awarded before the concerned Tribunal.

Now, a money withdrawal application has been filed by the respondent no.1/claimant.

Heard.

Let 40% of the deposited amount be released in favour of the respondent no.1/claimant. The amount shall be straightway transmitted to her bank account. Money withdrawal application stands disposed of accordingly.

List for final hearing on 02.05.2026.
