Heard Mr. Arvind Kumar Sharma, learned counsel for the petitioner and Mr. Hem Chandra Joshi, learned counsel for the respondent.

2. A recovery certificate dated 03.08.2025 was issued by the Prescribed Authority under the Payment of Wages Act, 1936.

3. Mr. Arvind Kumar Sharma, Advocate, submitted that the petitioner had filed a Writ Petition (M/S) No. 1877 of 2019 and pursuant to the order dated 06.08.2019, passed in the said writ petition, the petitioner had furnished bank draft of Rs.10,00,000/- and bank guarantee for the remaining recovery amount of Rs.20,76,000/- before the Appellate Authority. He further submitted that now, the movable property of the petitioner is under auction. The petitioner undertakes that a fresh bank draft of Rs.10,00,000/- and a fresh bank guarantee for the amount of Rs.20,76,000/- shall be filed before the Appellate Authority within twenty days' from today.

4. In view of the undertaking of the petitioner, the execution of the recovery certificate dated 03.08.2025 is kept in abeyance till 16.03.2026.

5. List on 16.03.2026.

6. Interim Relief Application (IA No.3 of 2025) is disposed of accordingly.
