This writ petition has been filed under Article 226 of the Constitution of India, whereby the petitioner has sought quashing of the order dated 30.01.2026, passed by respondent no.2-Additional Director, Secondary Education, Nainital and order dated 09.04.2025 passed by respondent, whereby the appointment of the petitioner had not been approved.

It is contended by learned counsel for the petitioner that the rejection has been done by respondent no.3-Chief Education Officer, Almora, on the ground that the permission was earlier granted for Assistant Teacher Arts, Sanskrit and Urdu while the advertisement was issued for four subjects apart from above three subjects one more subject i.e.- Social Studies and Science.

The petitioner has assailed the aforesaid orders on the ground that the respondent has committed illegality by cancelling the entire permission while permission so far as the Assistant Teacher (Urdu) for which the petitioner has applied has already been granted. The advertisement for Assistant Teacher, Social Studies and Science was without permission.

6. The contention raised by learned counsel for the

petitioner appears to be prima facie satisfactory.

7. The stand of respondent-State is required to be known by this Court to decide the controversy involved in the present writ petition, for which counter affidavit is needed.

8. Issue notice to the respondent no.4, returnable within four weeks.

9. Steps to be taken within a week.

10. List this case on 09.04.2026.

11. In the meantime, respondent(s) may file counter affidavit(s).
