The respondent no.1 filed a claim petition along with an Application under Section 5 of the Limitation Act, 1963 (Miscellaneous Case No.61 of 2024) before the learned Motor Accident Claims Tribunal/ District Judge, Dehradun. Learned Tribunal has allowed the Application, filed under Section 5 of the Limitation Act, 1963 vide impugned order dated 24.06.2025. The said case has now been registered as Motor Accident Claim Petition No.181 of 2025.

2. Mr. Lalit Belwal, learned counsel for the petitioner.

3. Mr. Lalit Belwal, Advocate, contended that in view of sub-section (3) of Section 166 of the Motor Vehicles, Act, 1988, the respondent no.1 was required to file the claim petition within six months of the accident.

4. Admit.

5. Notice is being issued to the respondents. Steps to be taken within a week.

6. List on 27.03.2026 with the record of WPMS No.2487 of 2025. Till then, the further proceedings of Motor Accident Claim Petition No.181 of 2025 are stayed.
