2. Mr. Anil K. Dabral, Additional C.S.C. with Mr. Suyash Pant, S.C. for the State.

3. This writ petition has been filed by the petitioner under Article 226 of the Constitution of India, whereby the petitioner has sought the following relief:-

"To Issue a writ, order or direction in the nature of mandamus directing the respective respondent authorities concerned to not to proceed with the on- going consolidation proceedings relating to the Gata Number 1 and 2, Khasra No.1/2. 1/3, 1/4 and 1/6 of the land situated at Village Chandanpur Tiwari Tehsil Ramnagar District Nainital, till the correction of revenue entries in the revenue records is corrected, during the pendency of the above captioned petition so that justice be done."

In a nutshell, the contention of the learned counsel for the petitioner is that a Khata Khatoni No.4 of the Village-Chandanpur Tiwari, Tehsil-Ramnagar, District- Nainital was recorded as water body in the revenue record of Fasli Year-1359, but in the revenue record of Fasli Year 1393-1398, the said land has been recorded as Category 1-A in Khata Khatoni No.4.

5. The grievance of learned counsel for the petitioner is that he wants this to be clarified by this Court by filing a present writ petition.

6. During course of the argument, it is admitted by learned counsel for the petitioner that for the said 2026:UHC:1055 purpose an application/proceedings have been initiated before the Settlement Officer (Consolidation), Rudrapur, Udham Singh Nagar.

7. In view of the aforesaid submissions made by learned counsel for the petitioner, this Court is of the view that instead of filing of the present writ petition the petitioner should pursue the application/proceedings which is pending presently before the Assessee- Settlement Officer (Consolidation), Rudrapur, Udham Singh Nagar.

8. Accordingly no interference is warranted at this stage and the writ petition stands dismissed in limine.
