3. Petitioner is serving as Registrar
Kanoongo in Joshiyara Tehsil of District
Uttarkashi. By means of this writ
petition, he has sought the following
reliefs:-
(i) Issue a writ in the nature of certiorari calling
for record and quashing the recommendation
dated 5.12.2025 (Annexure No. 1) sent by
the respondent no. 3 ignoring the petitioner
being Registrar Kanoongo.
(ii) Issue a writ in the nature of mandamus directing the respondents to sent requisition for promotion from amongst Registrar Kanoongo under the quota fixed for it, otherwise the petitioner shall suffer irreparable loss and injury at his verge of retirement.
4. Challenge thrown by the petitioner is to an inter-departmental letter issued by the Secretary, Board of Revenue to the Secretary, Revenue Department. By the said letter, a request has been made to send requisition for supplying available vacancies to hold promotion exercise for promoting Revenue Inspector to the post of Naib Tehsildar.
5. Petitioner contends that requisition for promotion of Registrar Kanoongo should also be simultaneously sent; otherwise, they will become junior to the 2026:UHC:1013
persons who will be promoted as Naib Tehslidar from the post of Revenue Inspector.
6. This Court does not find any reason to interfere with the inter-departmental communication. However, having regard to the facts and circumstances of the case, this Court thinks that ends of justice would be met, if petitioner is permitted to approach the Competent Authority by making representation.
7. Learned counsel for the petitioner submits that petitioner has already made a representation to the Secretary, Board of Revenue.
8. The writ petition is, accordingly, disposed of with a direction to the Secretary, Board of Revenue to take decision on petitioner's representation dated 18.11.2025, as per law, within six weeks from the date of presentation of certified copy of this order.
