An Original Suit (O.S. No. 1 of 2023) was filed by the respondent for perpetual injunction. An Application for temporary injunction was filed by the plaintiff. On 06.11.2025, learned Civil Judge (Senior Division), Vikasnagar, District Dehradun directed the parties to maintain status quo over the suit property. Aggrieved by the said order, the plaintiff filed a Miscellaneous Civil Appeal (No.13 of 2025). Learned Additional District Judge, Vikasnagar, Dehradun by the impugned order dated 15.01.2026, has allowed the appeal and restrained the petitioners-defendants from taking possession of the suit property and evicting the respondent-plaintiff. Hence, the present petition under Article 227 of the Constitution of India.
2. Heard Mr. Abhishek Verma, learned counsel for the petitioner and Mr. Ajay Joshi, learned counsel for the caveator / respondent.
