Hon'ble Alok Kumar Verma,J.

The temporary injunction application, filed by

the respondent - plaintiff, was dismissed by the trial

court on 21.11.2020. An Appeal (Miscellaneous Civil

Appeal No.17 of 2020) was filed by the respondent.

Learned District Judge, Nainital allowed the appeal and

restrained the petitioner from transferring the property

in-question to any third party by the impugned

judgment dated 27.11.2021.

2. The Withdrawal Application (IA No.3 of 2026)

is taken on record.

3. Heard Mr. Sudhir Kumar, learned counsel for

the petitioner-defendant and Mr. Shivam Singh Paragai,

2026:UHC:2696 learned counsel for the respondent.

4. Mr. Sudhir Kumar, Advocate, has requested

to permit the petitioner to withdraw the present writ

petition with liberty to raise all her contentions before

the learned trial court and learned trial court may be

directed to proceed with the trial without being

influenced by the impugned judgment.

5. The said request has not been opposed by

the respondent.

6. The present writ petition is dismissed as

withdrawn. The petitioner is at liberty to raise all her

relevant contentions before the learned trial court and

the learned trial court shall proceed with the trial

without being influenced by the impugned judgment

dated 27.11.2021, passed by learned District Judge,

Nainital.

7. It is made clear that this Court has not

expressed any opinion on the merit of the case.
