The applicant has assailed the order dated 31.03.2026 passed by learned IIIrd Additional Sessions Judge, Haridwar in Criminal Revision No. 05 of 2026, whereby the learned Revisional Court has allowed the Criminal Revision preferred by the respondent (wife) and set aside the order dated 27.11.2025 passed by the learned trial Court in Transfer Application No. 575 of 2025, and further directed the Court below to transfer the case record to itself or to any other competent Court at Haridwar for adjudication.

3. Learned counsel for the applicant submits that the miscellaneous application under Section 12 of the Domestic Violence Act was instituted by the respondent herself at Roorkee on 18.03.2020 and that she has been continuously contesting the case without any demur. It is further submitted that the transfer application preferred by the respondent was duly rejected by learned Chief Judicial Magistrate, Haridwar. However, in the revisional jurisdiction, learned IIIrd Additional Sessions Judge, Roorkee has erroneously allowed the said application on grounds which are non-existent and untenable in law, and the impugned order has been passed solely with a view to harass the applicant.

4. Issue notice to the respondent, returnable at an early date.

5. List after service report is received.

6. Considering the submission advanced by learned counsel for the applicant, it is directed that, till the next date of listing, effect & operation of the impugned order dated 31.03.2026, shall remain stayed.

7. Stay application (I.A. No.1 of 2026) stands disposed of.
