Mr. Shubhr Rastogi, learned counsel for petitioners, through V.C.

2. Mr. Bhupendra Singh Koranga, learned Brief Holder for the State of Uttarakhand/ respondent No.1.

3. Mr. Siddharth Jain, learned counsel for respondent No.2/Bank.

4. This writ petition has been filed by petitioners seeking a direction to respondents not to sale their immovable property and decide the representation dated 25.03.2026 regarding the One Time Settlement for their loan accounts and another ancillary relief.

5. Learned counsel for respondent No.2- Bank has made a statement at Bar that immovable property, which was secured asset to the loan advanced to petitioners, has already been auctioned on 23.01.2026 and a sale certificate has been issued in favour on one-Mr. Rohit Kumar on 06.02.2026.

6. Thus, he submits that writ petition has rendered infructuous when the auction has been made and sale certificate has been issued and finally the physical possession 2026:UHC:2480

has already been handed over to the auctioned purchaser i.e. Mr. Rohit Kumar.

7. In view of the above, nothing remains to be decided in the present writ petition and the same is accordingly dismissed as infructuous.
