Mr. Vaibhav Singh Chauhan, learned for the Appellant/Applicant.

2. Mr. Piyush Garg, learned counsel for the Respondent.

3. Present criminal appeal has been filed by the appellant against the judgment and order dated 20.03.2026 passed by learned Special Judge, Prevention of Corruption (C.B.I.)/3rd Additional Sessions Judge, District Dehradun.

4. Learned counsel for the applicant submits for consideration of bail firstly the applicant is a senior citizen of 75 years; secondly in the present matter he was not the beneficiary; and thirdly he was enlarged on bail during the course of trial and the punishment awarded is only of two years.

5. Learned counsel for the C.B.I. has opposed the bail application stressing that in the present matter offence under Section 409 of IPC is also inclusive and thus bail application be rejected.

6. Summon the lower court record.

7. After hearing learned counsel for the parties, this Court finds the sufficient ground for bail and the grounds advanced by learned counsel for the applicant seems to be reasonable.

8. Considering the fact that the other co- accused has been enlarged on bail and applicant is a senior citizen of 75 years old and also considering that till now there is nothing to say that applicant was the beneficiary, applicant is entitled to be released on bail.

9. Accordingly, bail application is allowed. Let the applicant-Paludas be released on bail on his executing a personal bond and two sureties of the like amount to the satisfaction of court concerned.

10. List this matter on 15.06.2026.
