This contempt petition has been filed alleging wilful disobedience of the Order dated 19.05.2025, passed in Special Appeal No.884 of 2017, "Smt. Meena Ray vs. State of Uttarakhand and Others".

2. By the Order dated 19.05.2025, the following direction was issued :-

"9.However, having regard to the facts and circumstances of the case, we dispose of the special appeal, with liberty to the Competent Authority to pass order afresh, after affording opportunity of hearing to writ petitioner as well as appellant; if it is found that writ petitioner was appointed in disregard of the income limit, fixed by the State Government."

3. The District Programme Officer, Udham Singh Nagar has passed a fresh order on 30.10.2025.

4. Heard Mr. Bhagwat Mehra, learned counsel for the petitioner and Mr. J.S. Bisht, learned Standing Counsel assisted by Mr. Devesh Ghildiyal, learned Brief Holder and Mr. Hargovind Pant, learned Brief 2026:UHC:2453 Holder for the State.

5. Mr. J.S. Bisht, Standing Counsel submitted on instructions that the order dated 30.10.2025 has been passed by the Competent Authority.

6. After the said submission of Mr. J.S. Bisht, Standing Counsel, Mr. Bhagwat Mehra, Advocate appearing for the petitioner, on instructions, has requested to permit the petitioner to withdraw this contempt petition with a liberty to challenge the order dated 30.10.2025, passed by the District Programme Officer, Udham Singh Nagar.

7. The said request has not been opposed by Mr. J.S. Bisht, Standing Counsel.

8. In view of the above, this contempt petition does not require any further consideration. The proceedings in the present contempt petition are closed by granting liberty to the petitioner-Km. Prema Sarkar to challenge the order dated 30.10.2025, passed by the District Programme Officer, Udham Singh Nagar, but in accordance with law.
