An Amendment Application was filed by the respondent no.1 - plaintiff in Original Suit No.20 of 2018, "Shri Karmjeet Singh vs. Smt. Beena Pal and Others", filed for mandatory injunction. The amendment application was dismissed by the trial court. A Revision (Civil Revision No.7 of 2025, "Karmjeet Singh vs. Smt. Beena Pal and Others", was filed. The said revision has been allowed vide judgment dated 06.03.2026, passed by learned Ist Additional District Judge, Rishikesh, District Dehradun.

2. Heard Mr. Sagar Kothari, learned counsel for the petitioners.

3. Mr. Sagar Kothari, Advocate, has contended that a written statement as well as counter-claim was filed by the petitioners - defendant nos. 4 to 7. In the counter claim, the petitioners had stated that they have purchased the property by way of a registered sale-deed dated 27.03.2018. The petitioners has sought perpetual injunction against the respondent no.1- plaintiff. The respondent no.1 was served with the copy of the written statement - counter claim on 29.01.2019. On 22.08.2024, the respondent no.1 filed the amendment application with the prayer to declare the said sale-deed dated 27.03.2018 a forged and void document. The respondent no.1 had knowledge of the sale-deed since 29.01.2019. Therefore, the relief sought by way of an amendment application was time barred and this aspect was totally ignored by the learned revisional court while passing the impugned order.

5. Notice is being issued to the respondents. Steps to be taken within a week.

6. List on 15.05.2026. Till then, the effect and operation of the impugned judgment dated 06.03.2026, passed by learned Ist Additional District Judge, Rishikesh, District Dehradun in Civil Revision No.7 of 2025, are stayed.
