Mr. Arvind Vashistha, learned Senior Counsel assisted by Mr. Siddhant Tiwari, learned counsel for the Appellant/Applicant.

2. Mr. Piyush Garg, learned counsel for the Respondent.

3. Present criminal appeal is filed by the appellant against the judgment and order dated 20.03.2026 passed by Special Judge, Anti Corruption (CBI) Dehradun in CBI Case No.02 of 2005 under Section 120-B, 420, 467, 468 and 471 of IPC and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act, 1988 arising out of the FIR No.RC0072003A0013 (Firstly, Case Crime No.194 of 2002), Police Station Ranipur, Haridwar.

4. The matter is listed for disposal of bail application.

5. Learned counsel for the applicant submits that applicant was on interim bail and during the course of trial he was enlarged on bail and the sentence so awarded to him was merely of two years. He requested that applicant may be granted bail.

6. Learned counsel for the respondent orally opposed the bail application.

7. Summon the lower court record.

8. Learned State counsel prays for and is granted two weeks time to file the counter affidavit.

9. Registry is directed to prepare the paper book and supply the same to the concerned parties, as per Rules.

10. After hearing learned counsel for the parties, this Court is of the view that since applicant was enlarged on bail and there is nothing that he defaulted the bail during the course of trial and considering the age of the applicant that he is a senior citizen of 72 years, applicant is entitled to be released on bail.

11. Accordingly, bail application is allowed. Let the applicant-Sukhpal Singh be released on bail on executing a personal bond and two reliable sureties of the like amount to the satisfaction of court concerned during the pendency of this appeal.
