4. Petitioner retired from the post of Work Agent from Uttarakhand Peyjal Nigam on 31.07.2025. Since his retiral dues have not been paid so far, therefore, he has approached this Court seeking the following relief:-

(i) To issue a writ order or direction in the nature of Mandamus commanding the Respondents to forthwith release the outstanding retiral benefits to the petitioner, details whereof is given herein below:-

A) Gratuity = Rs. 10,94,610 (approx.) (Sanctioned but not paid) B) Leave Encashment (300 days) = Rs. 6,63,400/- (approx.) (Sanctioned but not paid) C) Dearness Allowances = Rs. 54,748 (approx.) (Sanctioned but not paid) Total Amount = Rs. 18,12,758/-

5. Ms. Manshi Chauhan, learned counsel appearing for Uttarakhand Peyjal Nigam while admits the liability of Peyjal Nigam to pay the outstanding dues of the petitioner, however, she submits that due to financial constraints, the dues 2026:UHC:2291

could not be released so far. She assures that all the pending dues of the petitioner shall be released as early as possible.

6. The writ petition is, accordingly, disposed of by directing the Managing Director, Uttarakhand Peyjal Nigam to release the amount of Leave Encashment and Dearness Allowance to the petitioner, within two months and the amount of Gratuity & other pending dues shall be released to petitioner within four months from the date of presentation of certified copy of this order before him.
