JUDGMENT :
(per Mr. G. Narendar, C.J.)
1. Heard learned counsel for the appellant and the
learned Additional Chief Standing Counsel for the State.
2. Perused paragraph nos.5, 6, 7, 8, 9, 10 and 11
of the impugned judgment passed by the learned Single
Judge.
3. Petitioner has been serving in Haridwar for the
last three decades and has now been transferred out of
Haridwar to Dehradun. The claim that he being a senior
employee and compulsory transfer is prohibited has been
considered by the learned Single Judge. The prohibition

is applicable only to the transfer of a senior employee
from an accessible area to a remote area. In the instant
case, the transfer is from one accessible area to another
accessible area. In that view, the prohibition canvassed
by the learned counsel for the appellant, is misplaced and
without substance.
4. The appeal, being devoid of merit, is
accordingly, rejected.
