4. Heard Mr. Saurabh Kumar Pandey, learned counsel for the applicant, Mr. Priyanshu Gairola, learned counsel for respondent no.2 and Mr. Chitrartha Kandpal, learned Brief Holder for the State.

5. By means of the present C-528 application, the applicant has put to challenge the order dated 07.07.2025 passed by learned 1st Additional Sessions Judge, Dehradun in Criminal Revision No.133 of 2025, Jagmeet Singh and another vs. State of Uttarakhand and another, whereby the revision preferred by respondent no.2 has been allowed and the order dated 17.04.2025 passed by the learned Trial Court has been set aside and the Trial Court is directed to decide the protest petition filed by the applicant afresh in the light of the observation made in the body of the judgment and order dated 07.07.2025.

6. Issue notice to the respondent no.3 returnable within four weeks. Steps to be taken within three days.

7. Respondents may file their counter affidavit within four weeks. Two weeks' thereafter, rejoinder affidavit, if any, may be filed.

8. List this case on 19.11.2025.

9. In the meantime, the effect and operation of the

impugned judgment and order dated 07.07.2025 passed by the learned 1st Additional Sessions Judge, Dehradun in Criminal Revision No.133 of 2025, Jagmeet Singh and another vs. State of Uttarakhand and another shall remain stayed till the next date of listing.

10. Stay Application (IA No.1 of 2025) stands disposed of accordingly.
