Mr. M.S. Bisht, learned counsel for the Revisionist.

2. The present Criminal Revision has been filed against the judgment and order dated 13.03.2023, passed by the learned Additional Chief Judicial Magistrate, Kotdwar, District Pauri Garhwal, in Criminal Complaint Case No. 1728 of 2020, Ajay vs. Surendra Kumar, under Section 138 of the Negotiable Instruments Act, 1881, read in conjunction with the judgment and order dated 25.06.2024, passed by the learned Additional Sessions Judge, Kotdwar, District Pauri Garhwal, in Criminal Appeal No. 08 of 2023, Surendra Kumar vs. Ajay and Another.

3. As per the custody report, computing the period from 04.12.2024 to 14.10.2025, the convict-Surendra Kumar has undergone 10 months and 12 days of incarceration in jail.

5. Issue notice to the Respondent.

6. Steps to be taken within one week.

7. List this case on 18.12.2025 for further hearing.

8. Heard on the Bail Application (I.A. No. 02 of 2024).

9. Considering that the Revisionist has already undergone approximately ten months of incarceration, and taking into account the facts and circumstances of the case, this Court is of the considered opinion that sufficient grounds exist to grant bail to the Revisionist during the pendency of the present Criminal Revision.

10. Accordingly, it is directed that the Revisionist-Surendra Kumar shall be released on bail, upon executing a personal bond of ₹50,000/- (Rupees Fifty Thousand only) and furnishing two reliable sureties, each in the like amount, to the satisfaction of the Trial Court concerned.

11. It is, however, clarified that the grant of bail shall not be treated as a ground for seeking adjournments or for delaying the disposal of the present Revision.
