3. Since common questions of fact and law are involved in these petitions, therefore, these petitions are clubbed together and decided by this common judgment.
4. Petitioners were appointed as Group-D employees in Irrigation Workshop, Roorkee on different dates. According to them, certain benefits, including upgraded pay scale was payable to them as per Government Policy, however, the same has not been paid, therefore, they have approached this Court seeking a writ of mandamus commanding the authorities to grant them the benefits, which have been due.

5. Learned State Counsel, however, submits that Division Bench of this Court in Special Appeal No. 370 of 2022 has decided similar issue and in view of that judgment, the benefits, which petitioners are claiming, cannot be granted to them.

Learned counsel for the petitioners, however, relies upon judgment rendered by learned Single Judge in Writ Petition (S/S) No. 1968 of 2014, whereby the authorities were directed to grant grade pay of Rs.1800/- to the petitioner, as per 6th Pay Commission Report. He submits that the said judgment was affirmed by Division Bench of this Court and the SLP filed the said judgment, was dismissed by Hon'ble Supreme Court.

Learned State Counsel submits that in Writ Petition (S/S) No. 1968 of 2014, petitioner had sought mandamus to grant him benefit of revised pay scale in the Grade Pay of Rs.1800/-, whereas petitioners in these writ petitions are staking claim for much higher grade pay. He further submits that petitioners have already granted salary in the grade of Rs.2800/-.

Be that as it may, since petitioners have sought a mandamus to grant them a particular grade pay and that decision can only be taken by the competent authority, therefore, the writ petitions are disposed of with liberty to petitioners to make representation(s) to the competent authority. If they make representation(s) within two weeks from today, competent authority shall look into their claim and take appropriate decision, as per law, within six months thereafter.
