The appellant seeks leave of the Court to challenge the judgment and order dated 09.12.2022, passed in Criminal Complaint Case No.196 of 2016, Mohd. Ashraf vs. Mohd. Yunus, by the court of Judicial Magistrate, Kashipur, District Udham Singh Nagar, by which, he has been acquitted. Heard.
Learned counsel for the appellant would submit that he has sold a property to the respondent; in lieu thereof the respondent had issued a cheque, which when presented, was dishonoured. Learned counsel for the respondent would submit that the sale-deed was never executed. It has already been cancelled. Having considered, this Court is of the view that this matter requires deliberation. Leave to appeal is allowed. Call for the LCR.
The matter shall be heard. The respondent is already appearing. List for final hearing on 19.06.2025.
