1. Mr. Gaurav Singh, learned counsel for the appellant.
2. Mr. Himanshu Sain, learned Brief Holder for the State.
3. This is an admitted appeal admitted on 20.09.2022 and the trial court record were also summoned which has now been received.
4. Instant appeal has been preferred by the appellant against the judgment and order dated 23.07.2022 passed by the FTSC/Addl. Session Judge, Roorkee, Haridwar in S.T.No. 121 of 2020, State vs. Vinay, arising out of case crime no. 176 of 2020 wherein the present appellant has been convicted and sentenced for an offence punishable under Section 363 IPC with three years rigorous imprisonment and in default of payment of fine he has to further undergo three months additional imprisonment.
5. Learned counsel for the appellant submits that the appellant was on bail during trial and furthermore while convicting by the trial court, the appellant was granted interim bail and this Court while admitting the appeal extended the interim bail only for 30 days.
