JUDGMENT:
(per Hon'ble The Chief Justice Sri G. Narendar)
The instant writ petition was filed challenging the
rejection of the tender by the petitioner, as it was
declared non-responsive.
2. In the morning, it was submitted by the learned
State Counsel that the tenderer/petitioner had made a
request for return of the Bank Guarantee.
3. The petitioner having made such a request, it can be
safely inferred that he has abandoned his right and the
petition preferred after requesting for return of Bank
2025:UHC:5389-DB Guarantee and the E.M.D., in our opinion, is misconceived
and is, accordingly, rejected.
4. The copy of the communication, releasing the
security and the Bank Guarantee in favour of the
tenderer, is placed on record in the post lunch session.
5. Accompanying applications if any pending stand
disposed off.
6. There shall be no order as to costs.
