                              JUDGMENT

Hon'ble Ravindra Maithani, J. (Oral)

The petitioner claims family pension after the death of

his wife.

2. Heard learned counsel for the parties and perused the

record.

3. Learned counsel for the petitioner would submit that

the wife of the petitioner was working as a Teacher. After her

retirement, she received pension, but she died on 30.05.2021. The

petitioner is being husband is entitle to for family pension, but it is

being denied to the petitioner for the last four years, for no reasons.

4. Learned State Counsel would submit that certain

documents are required to be submitted by the petitioner, which he

is not submitting. Therefore, the matter is delayed.

5. This Court is of the view that this matter may not be

kept pending. With the certain directions, the petition may be

disposed of at the stage of admission itself. The Court, therefore,

issues the following directions:-

(i) The respondent no.3, the Chief Education Officer,

Nainital shall communicate the petitioner within a

week from today requiring him to submit such

documents, which are required to be filed by the

petitioner in order to process his claim for Family

Pension. This communication should be in writing

and it should be acknowledged by the petitioner.

(ii) Once such communication is received by the petitioner,

as stated above, the petitioner shall submit requisite

documents within two weeks, thereafter, to the

respondent no.3, the Chief Education Officer, Nainital.

He will also obtain a receipt of it.

(iii) Once steps (i) and (ii) as above, are undertaken, the

respondent no.3, shall process and decide the claim of

the petitioner for family pension within four weeks

thereafter.

6. With the aforesaid directions, the petition stands

disposed of, accordingly.
