2. Mr. S.S. Chauhan, Deputy Advocate General with Mr. Vikas Uniyal, Brief Holder for the State.
3. Pursuant to the order dated 02.12.2024 passed by the Coordinate Bench of this Court, the supplementary affidavit has been filed annexing the Income Tax Return of the revisionist-husband. The same is taken on record.
4. This revision is directed against the judgment and order dated 20.09.2024 passed by the Principal Judge, Family Court, Dehradun in Misc. Criminal Case No.498 of 2023, Smt. Jasleen vs. Angad Pal Singh, whereby, the application for interim maintenance presented by the respondent no.2 has been partly allowed and the revisionist is directed to pay a sum of Rs.15,000/- per month to respondent no.2- Smt. Jasleen Bhatia (wife) and Rs.10,000/- per month to minor son Master Joravar Singh as interim maintenance from the date of filing of the application. The interim maintenance of Rs.25,000/- has to be paid by 10th of each month.
5. It is contended by the learned counsel for the petitioner on the basis of the average of the Income Tax Return that the income of the husband comes to Rs.41,000/- approximately.
6. I have also perused the Income Tax Return and found substance in the submission made by learned counsel for the revisionist.
7. Learned counsel for the revisionist says that out of Rs.41,000/-, Rs.25,000/- has been directed to be paid as interim maintenance in favour of respondent no.2 and his minor son Master Joravar Singh.
8. Having heard the learned counsel for the parties and on perusal of the record and documents filed in support of their contention, this Court is of the view that apparently the amount is on a higher side.
9. Issue notice to the respondent no.2 returnable within 6 weeks. Steps to be taken within three days.
10. List this case on 25.09.2025.
11. In the meantime, execution of the judgment and order dated 20.09.2024 impugned in the present criminal revision shall remain stayed provided the revisionist- husband shall pay a sum of Rs.8,000/- to his wife Smt. Jasleen and Rs.4,000/- to his minor son Joravar Singh during the pendency of the revision. He is further directed to pay 25% arrear to respondent no.2 (wife) and his minor son within three months from today.
