(2) Objection pointed out by the Registry is overruled.

(3) According to petitioners, they were appointed as non-teaching employee in an unaided junior high school in the year 2001 and 2005 respectively and the said institution was subsequently taken in the grant-in-aid list of the State Government in 2014; they are being paid salary from public exchequer with effect from 1.4.2016, however they have not been paid any salary for the period between 4.3.2014, when the institution was included in the grant-in-aid list, and 1.4.2016, from when they were paid salary from public exchequer. By means of this writ petition, petitioners have sought the following relief:

"i) A writ, order or direction in the nature of mandamus directing/commanding the respondents to pay the arrear of the salary to the petitioner from 4.3.2014 to 31.1.2016 with applicable interest thereon."

(4) Learned Counsel for the petitioners relies upon a judgment rendered by coordinate Bench, which, according to him, was affirmed by the Division Bench.

(5) Learned State Counsel, however, submits that petitioners should have 2025:UHC:7586

approached the competent authority before rushing to this Court. (6) Accordingly, writ petition is disposed of by permitting the petitioners to make representation. If petitioners make representation within two weeks from today, District Education Officer, Tehri shall consider the claim staked by petitioners and take decision, as per law, within four months thereafter.
