2. This is an appeal filed under Section 173 of Motor Vehicle Act, challenging the judgment and award dated 20.02.2025 passed by M.A.C.T/Additional District Judge, Khatima, District Udham Singh Nagar in Motor Accident Claim Case No.88/2022, whereby the claim petition filed by respondent nos.1 to 4 was allowed against the appellant for a sum of ₹ 12,65,200/-.

3. As per the report of Registry, there is a delay of 43 days in filing the appeal.

4. Notices were issued to respondent nos.1 to 6. Office report indicates that respondent nos.3, 5 and 6 have been served personally, while respondent no.1 has been served through his father-in-law, respondent no.2 through grandfather and respondent no.4 through her husband.

5. Heard and perused the delay condonation application.

6. In view of sufficiency of reasons stated in the delay condonation application, delay in filing the appeal is condoned. Delay Condonation Application stands allowed.

7. Learned counsel for the appellant submits that execution proceedings are pending against the appellant. He further submits that he is ready to deposit the entire awarded amount along with interest, if any, before the Tribunal concerned.

8. In view of the above, the appellant is directed to deposit the entire awarded amount, along with interest, before the Tribunal concerned within a period of four weeks from today.

9. In case, the amount as directed above, is deposited by the appellant within four weeks, the effect and operation of impugned Award dated 20.02.2025 shall remained stayed.

10. List on 25.09.2025 for admission/orders.
