JUDGMENT :

(per Ms. Ritu Bahri, C.J.)

Present Appeal has been filed by the appellant-

wife challenging the order dated 14.03.2024 passed by

the learned Judge, Family Court, Haldwani in

Matrimonial Case No. 162/2021 titled as 'Amandeep

Saluja vs. Pawanjyot Kaur @Ena' under Section 13 of

the Hindu Marriage Act, 1955, whereby the opportunity

of the appellant to cross-examine PW-1 has been

closed.

2. Today, learned counsel for the respondent states

that the respondent has no objection, if one single

opportunity is given to the appellant to cross-examine

the witnesses.

3. Therefore, since the counsel for the respondent is

not objecting to the Appeal filed by the appellant that

her right to cross-examine the witnesses can continue, 2024:UHC:6405-DB the impugned order dated 14.03.2024 passed by the

learned Judge, Family Court, Haldwani in Matrimonial

Case No. 162/2021 titled as 'Amandeep Saluja vs.

Pawanjyot Kaur @Ena' under Section 13 of the Hindu

Marriage Act, 1955 is set aside and a direction is given

to the Family Court to give one single opportunity to

the appellant to cross examine all the witnesses.

4. In view of the above direction, the Appeal stands

allowed.

5. Pending application, if any, also stands disposed

of.
