The petitioners have brought to the notice of the Court that judgment and order dated 08.08.2019, passed by the Division Bench of this Court in WPSB No.68 of 2013, Jagdish Chandra Kandpal and Others Vs. State of Uttarakhand and others, has been wilfully disobeyed by the respondent-contemnor.
The Court posed a question to learned counsel for the petitioners as to how a contempt petition may now be entertained after lapse of almost three years from the date, on which the contempt was alleged to have been committed, in view of Section 20 of the Contempt of Courts Act, 1971 ("the Act")? He would submit that after the order dated 08.08.2019, a representation was given by the petitioner. Long thereafter, a tentative seniority list has been prepared, which is not in accordance with the order.
The question is whether a party may extend the period of limitation under Section 20 of the Act, by way of filing some representation in between?
The Court will hear on this issue on 09.10.2023.
