Hon'ble Sharad Kumar Sharma, J.
Mr. Yashpal Singh, Advocate, for the petitioners.
Mr. Yogesh Chandra Tiwari, Standing Counsel, for the State of Uttarakhand.
This matter is listed on the Withdrawal Application, preferred by the petitioners, seeking withdrawal of the Writ Petition, on the ground that as against the impugned judgments, which are under challenge, the judgment debtors / defendants have already handed over the actual physical possession to the decree holders, i.e., plaintiffs/ petitioners, herein, and the keys were handed over of the tenement, in the Court in Execution Case No. 1 of 2021.
Since the very purposes of the proceedings have already frustrated, and the possession has been handed over to the petitioners in Execution Case No. 1 of 2021, the Writ Petition is hereby dismissed as having rendered infructuous, in view of the pleadings raised in the Withdrawal Application.
