Mr. Pankaj Miglani, learned counsel for the petitioner.
2. Mr. Narayan Dutt, learned Brief Holder for the State.
3. By means of this writ petition, the petitioner has sought a direction to respondent no.2 to treat the appointment of the petitioner, on compassionate ground, as a regular one and to grant him consequential benefit, therefor.
4. It is the contention of learned counsel for the petitioner that father of the petitioner died on 14.08.2014 leaving behind petitioner and his wife. The petitioner applied for compassionate appointment in place of his father and vide order dated 01.06.2015, he was appointed as a Daily Wager (Work Superintendent), on compassionate ground.
5. Learned counsel for the petitioner submitted that compassionate appointment cannot be given as a Daily Wager, therefore, the action of respondent in granting Daily Wager appointment to the petitioner is against law and the judgment rendered by the Co-ordinate Bench of this Court and other Courts as well.
6. Learned State counsel prays for and is granted three weeks' time for filing counter affidavit.
