1. Mr. Siddharth Singh, learned counsel appears for the petitioner and Mr. Piyush Garg, learned counsel appears for the caveator / sole respondent.
2. The instant writ petition has been filed by the
petitioner challenging the order dated 10.01.2019
passed by the Judge, Small Causes Court / Civil Judge,
Senior Division, Rishikesh in SCC Case No. 2 of 2023
Sudha Rani vs. Devi Prasad whereby the said case was
decreed, as well as the judgment and order dated
06.09.2023 passed by the II Additional District Judge,
Rishikesh in SCC Revision No. 11 of 2020 Devi Prasad
vs. Sudha Rani, whereby the said revision dismissed
and the order dated 10.01.2019 was confirmed.
3. Learned counsel for the petitioner submits that
the plaintiff/respondent is not the owner of the shop-in-
question and, in fact, the present petitioner is the
owner of the shop-in-question.
4. Let both the counsel place before this Court the
relevant documents with regard to the actual ownership
of the shop-in-question. For this purpose, both the counsels pray for and are granted three weeks' time.
5. Put up this matter on 21.11.2023.
6. In the meantime, both the parties are directed to
maintain status quo in respect of the shop-in-question.
