(1) Ms. Disha Vashisth, Advoate holding brief of Mr. K.R. Gazi, learned counsel for the appellant.

(3) This appeal is filed under Section 374(2) of Cr.P.C. against the judgment and order dated 19.09.2023 rendered by learned Additional Sessions Judge / F.T.S.C., Roorkee, District Haridwar in Sessions Trial No. 260 of 2021, whereby appellant has been convicted under Sections 376(D) and 323 of I.P.C. He has been directed to undergo rigorous imprisonment for 20 years under Section 376(D) I.P.C. with fine of ₹30,000/- and, in default of payment of fine, he was sentenced to undergo further six months additional imprisonment; he has also been sentenced to undergo rigorous imprisonment for six months under Section 323 I.P.C. with fine of ₹500/- and, in default of payment of fine, he was sentenced to undergo further seven days additional imprisonment. It was directed that all the sentences shall run concurrently.

(4) As per Office report, appeal is filed within time.

(5) Admit.

(6) Summon the lower court record.

(7) List this case on 28.12.2023.

(8) In the meantime, State Counsel may file objection to the bail application (IA No. 1 of 2023), if any.
