(3) This is jail application filed through Legal Aid Counsel.

(4) An application seeking exemption from requirement of filing affidavit in support of bail application has been filed.

(5) For the Reasons indicated in the application, the same is allowed. The requirement of filing affidavit in support of bail application is exempted.

                                  (7)    This is jail appeal against conviction, filed

under Section 374(2) r/w Section 383 CrPC against judgment and order dated 09.08.2023 passed by learned Sessions Judge, Nainital in Sessions Trial No. 32 of 2019, whereby appellant has been convicted under Section 302 IPC and sentenced to undergo rigorous imprisonment for life with fine of ` 50,000/- and, in default of payment of fine, he was sentenced to undergo three years additional simple imprisonment.

(8) As per office report, the appeal is within time.
