(1) Mr. B.M. Pingal, Advocate holding brief of Mr. Vivek Shukla, learned counsel for the appellant.

(2) Mr. B.S. Kathayat, learned counsel for the respondent.

(3) Appellant filed divorce petition before Judge, Family Court, Haridwar, which was dismissed vide judgment dated 17.02.2021. Challenging the said judgment, appellant filed this appeal.

(4) Today, when the matter was taken up, learned counsel for the parties unanimously submit at bar that parties have amicably settled the dispute and they jointly filed an application, under Section 13-B of Hindu Marriage Act, which was allowed by Judge, Family Court, Haridwar vide order dated 31.08.2023.

(5) Learned counsel for appellant submits that in view of subsequent development, appellant does not want to press the appeal for which appellant has moved withdrawal application.

(6) In such view of the matter, withdrawal application (IA No. 3 of 2023) is allowed.

(7) Accordingly, appeal is dismissed, as withdrawn.
