The Court made the following:
JUDGMENT:(per Hon'ble The Chief Justice Sri Vipin Sanghi)
After some arguments, Mr. Parikshit Saini, learned
counsel for the petitioner submits that the petitioner would be
satisfied if the respondents consider his case for posting in a
Sugam area on the ground of his medical condition.
2. The petitioner states that he has already made a
representation on 21.04.2023 for consideration of his case on
medical grounds for posting in a Sugam area.
3. Let the said representation be considered, and a
Medical Board be constituted for examination of the
petitioner, and for obtaining the report whether the petitioner
can be posted in a Durgam area, within fifteen days.
4. We, however, make it clear that we have not
expressed any opinion on the merits of the petitioner's case.
5. This order shall be served on the respondents by
the petitioner within one day.
6. The writ petition is disposed of in the aforesaid
terms.
7. Pending application, if any, also stands disposed of.
8. Let a certified copy of this order be issued to
learned counsel for the petitioner, today itself, as per Rules.
