Heard Mr. S.S. Yadav, learned counsel for the petitioner and Mr. P.C. Bisht, Additional C.S.C. for the State. (2) The present writ petition has been filed for the direction to the respondent no. 3 to decide her pending application moved under Section 13 (b) of the Uttarakhand Annual Transfer for Public Servants Act, 2017 (hereinafter referred to as 'the Act'), which is Annexure No. 3 to the writ petition. (3) It is the contention of learned counsel for the petitioner that application under Section 13(b) has been moved by the petitioner way back on 08.05.2023 on the ground of her suffering from acute case of depression, which has not yet been decided despite transfer season has been over. (4) Per contra, learned State Counsel does not dispute the fact that this application moved by the petitioner dated 08.05.2023 under Section 13(b) of the Act is still undecided and is pending with the competent authority.

(5) It is submitted by the learned counsel for the petitioner that on 28.06.2023, a representation has again been moved by the petitioner to the Additional Director, Secondary Education, Garhwal Mandal, Pauri Garhwal to decide her application and to transfer her in any of the college mentioned in the representation dated 28.06.2023.

(6) Having heard the learned counsel for the parties, the writ petition is disposed of with the direction to the Additional Director of Secondary Education, Garhwal Mandal, Pauri Garhwal to decide the representation dated 28.06.2023, within a period of four weeks, from the date of receipt of certified copy of this judgment and order, in accordance with law, with a speaking order sympathetically and to post the applicant in one of the colleges, enumerated in Annexure-4, if the representation is decided in favour of the petitioner.
