Mr. Dushyant Mainali, learned counsel for the petitioners.
Mr. Atul Bahuguna, learned Standing Counsel for the Union of India/respondent no.1 Ms. Monika Tripathi, learned Addl. C.S.C. for the State/respondent nos.2 to 4.
The petitioners claim that one set of outsourced employees are being substituted by the State by another state of outsourced employees.
Learned counsel appearing for the petitioners relies upon a Judgment of the Division Bench of this Court in WPSB No.19 of 2023 dated 12.01.2023.
Rule nisi.
In view of the order passed by the Division Bench presided by the Hon'ble Chief Justice of this Court, it is directed that till the next date of listing the contractual employment of the petitioners shall not be disturbed. However, it is further made clear that no equity is created in their favour by continuation of their contractual employment under this order.
Mr. Atul Bahuguna, learned Standing Counsel for the Union of India accepts notice on behalf of respondent no.1 and Ms. Monika Tripathi, learned Addl. C.S.C. for the State accepts notice on behalf of respondent nos.2 to 4 and have been served with the copy of the brief.
Let the learned counsel for the respondents file counter affidavit within six weeks.
Rejoinder affidavit within two weeks thereafter.
