Proposed Criminal Revision has been filed

challenging the judgment dated 27.10.2023, passed by

learned Vth Additional Sessions Judge, Haridwar in Criminal

Appeal No.121 of 2019, by which, the learned Appellate

Court has dismissed the Appeal and affirmed the judgment

dated 04.05.2019, passed by learned Ist Judicial

Magistrate, Roorkee, District Haridwar in Criminal Case

No.3053 of 2014, whereby, the revisionist was convicted

and sentenced to undergo simple imprisonment for a

period of six months along with a fine of Rs. 500/- under

Section 323 read with Section 149 of the Indian Penal

Code, 1860 (in short, "IPC"), and, he was further

convicted and sentenced to undergo simple imprisonment

for a period of three years along with a fine of Rs.1,000/-

under Section 325 read with Section 149 IPC.

2. Mrs. Neetu Singh, Advocate, contended that

there are material contradictions in the statements of the

prosecution's witnesses.

3. Admit.

4. Issue notice to informant-Soraj.

5. Steps to be taken within a week.

6. List on 06.03.2024.

7. Heard on the Bail Application (IA No. 01 of

2023).

8. Mrs. Neetu Singh, Advocate, submits that the

revisionist, aged about 64 years, was on bail during the

trial and the appeal, and, the conditions of bail were never

misused by him.

9. Considering the facts and circumstances of the

case, this Court is inclined to grant bail to the revisionist

Bijendra.

10. Let the revisionist- Bijendra be released on bail

on his executing a personal bond and furnishing two

reliable sureties, each in the like amount, to the

satisfaction of the Trial Court.
