An Application under Section 12 of the Protection of Women from Domestic Violence Act, 2005 (for short, "Act", 2005) was filed by the respondent no.2. The said Application was allowed. An Appeal was filed. The said Appeal (Appeal No.34 of 2021) has been dismissed vide judgment dated 20.06.2023, passed by learned Sessions Judge, Tehri Garhwal.
2. Heard Mr. S.R.S. Gill, learned counsel for the revisionists, Mrs. Manisha Rana Singh, learned AGA for the State and Mr. Lalit Sharma, learned counsel for the respondent no.2.
3. Mr. Rakesh Singh, revisionist no.1, is present through video conferencing. 4 Respondent no.2 Smt. Dila Devi, is not present.
5. Revisionist no.1 is identified by Mr. S.R.S. Gill, Advocate.
6. Mr. Rakesh Singh, revisionist no.1, submits that he will pay all the outstanding amount within fifteen days' from today.
7. List on 13.10.2023.
8. Subject to pay the entire outstanding amount to the respondent no.2 within fifteen days from today, the impugned order dated 28.08.2021, passed by learned Judicial Magistrate, Tehri Garhwal in respect of Residence Order under Section 19 of the said Act, 2005 is kept in abeyance till the next date of listing.
9. Personal appearance of revisionist no.1 Mr. Rakesh Singh, and respondent no.2 Smt. Dila Devi, are exempted.
