1. Mr. Tapan Singh, learned counsel for the petitioner.

2. Mr. Arvind Vashistha, learned Senior Advocate, assisted by Mr. Vivek Pathak, learned counsel for respondent no.1.

3. Mr. Pradeep Kumar Chauhan, learned counsel for respondent no. 4.

4. During the course of argument, Mr. Arvind Vashistha, learned Senior Advocate, has placed reliance on the judgment rendered by the Hon'ble Supreme Court in the case of Rasiklal Manikchand Dhariwal and Another, vs. M.S.S food products, (2012) 2 SCC 196 and particularly, gives reference of Para 41 of the judgment and submits that the application under Order 9 Rule 7 of C.P.C is not maintainable.

5. Mr. Tapan Singh, learned counsel for the petitioner, seeks some time to address on this point.

6. On his request, list this matter in the next week.
