The Court made the following:
JUDGMENT:(per Hon'ble The Chief Justice Sri Vipin Sanghi)
The petitioner is a public servant. He has raised a
dispute with regard to the promotion to the post of Deputy
Director, State Archive in Directorate of Culture, Uttarakhand.
The said dispute squarely falls for consideration by the
Uttarakhand Public Services Tribunal.
2. However, learned counsel for the petitioner states
that he is limiting his prayer to a decision by the
respondents- authorities on his representation.
3. We, accordingly, dispose of this petition with a
direction to the respondents- authorities to decide the
petitioner's representation dated 16.05.2023, by a reasoned
and speaking order within the next six weeks, and
communicate the same to the petitioner.
4. We make it clear that we have not examined the
petitioner's claim on merits.
5. In case the petitioner is aggrieved by the decision
that may be communicated to him, it shall be open to him to
approach the Uttarakhand Public Services Tribunal.
6. The writ petition is disposed of in the aforesaid
terms.
7. Pending application, if any, also stands disposed of.
