The grievance of the present applicants is as against the proceedings of Criminal Complaint Case No. 953 of 2022, which has been drawn by the respondent No. 2, for the engagement of the present applicants for the offences under Sections 147, 149, 323, 504, 506 of IPC, which stands registered before the Court of Judicial Magistrate, Bazpur, District Udham Singh Nagar.
The C482 Application entails consideration of factual dispute which has been attempted to be argued by the learned counsel for the applicants. But, considering the fact that all the offences for which the applicants have been summoned by the impugned orders which are under challenge, they carry a sentence of less than 7 years; they would be falling within an ambit of consideration as per the guidelines framed by the Hon'ble Apex Court in the matters of Satender Kumar Antil Vs. Central Bureau of Investigation and Another, as reported in 2022 (10) SCC 51.
If the applicants surrender before the Court of Judicial Magistrate, Bazpur, District Udham Singh Nagar, within a period of 10 days from today, their bail applications would be considered in the light of the framework provided by para 3(e) of the aforesaid judgment of the Hon'ble Apex Court.
Subject to the aforesaid, C482 Application would stand disposed of.
