Mr. C.S. Rawat, learned Chief Standing Counsel for the State of Uttarakhand/ respondents.

Mr. Prakash Arya, the Divisional Forest Officer, Tarai West, Forest Division Ramnagar is present. He states that a large number of stone crushers have been set up on both sides of Kosi River. He submits that the Kosi River is accessible from numerous points, and it is practically impossible to check the illegal mining being carried out on the riverbed, and transportation of the RBM, which is being illegally mined. He submits that the RBM, which is being illegally mined, is being supplied to the stone crushers, which are utilizing the same. He further submits that, in case the stone crushers are regulated, and there is no taker of the RBM, which is illegally mined from the river, the illegal mining itself could be curbed.

Mr. Rawat, learned Chief Standing Counsel submits that the District Anti Illegal Mining Force has been constituted in each district of the State, in terms of the judgment dated 03.09.2019 passed in Writ Petition (PIL) No. 107/2018, which was reiterated by us in our order dated 16.03.2023.

We direct the District Anti Illegal Mining Force, Udham Singh Nagar to forthwith look into the aforesaid aspect and take appropriate steps.

A further affidavit be filed before the next date, disclosing what directions have been issued by the District Anti Illegal Mining Force, and what steps have been taken in pursuance thereof.
