There have been multiple sale transactions in relation to an immovable property, including the one which was made by the present applicant to the complainant, which has resulted into the registration of the FIR No. 187 of 2021, for the alleged involvement of the present applicant for the commission of the offences under Sections 420, 504 and 506 of the IPC, on which, the Criminal Case No. 4426 of 2022, State of Uttarakhand Vs. Praveen Goyal, has been registered, and which is presently pending consideration before the Court of 2nd Addl. Chief Judicial Magistrate, Dehradun.
Without venturing into the merits of the matter, and as prayed for by the applicant's Counsel, this C-482 Application is being disposed of with the liberty left open for the applicant to resort to his remedies as laid down by the Hon'ble Apex Court in the matter as reported in (2022) 10 SCC 51, Satender Kumar Antil Vs. Central Bureau of Investigation and another. The applicant may resort to his remedies as available for 'A' category of offences, as per the guidelines framed in para 3 (e) of the said judgment.
Subject to the aforesaid, the C-482 Application would stand disposed of.
