1. By filing this writ petition, the petitioner has prayed for the following reliefs:

"i. To issue a writ, order or direction in the nature of certiorari quashing the impugned order dated 08.08.2022 issued by respondent no. 3 (contained as Annexure No. 4 to this writ petition) or mould the relief appropriately keeping in view of the facts highlighted in the body of the writ petition.

ii. Issue a writ, order or direction in the nature of Mandamus directing the respondents authorities to issue Caste Certificate of Other Backward Class (Chhipi) in favour of petitioner forthwith"

2. No counter affidavit has been filed by the respondents / State. Caste Certificate is denied to the petitioner only on the

ground that petitioner has not enclosed any evidence of her residing in the State of Uttarakhand since 1985.

3. It is apparent from the records that petitioner was born in the State of Uttarakhand on 10.12.2000 and is residing in the State of Uttarakhand since then. Other Backward Class caste certificate has also been issued by the respondent authorities in favour of her father. She has also annexed a copy of birth certificate, copy of permanent resident certificate and caste certificate issued to her father as Annexure Nos. 1 and 4 to the writ petition. Considering all the above documents, I do not find any reason to deny the caste certificate to the petitioner.

For the purpose of clarity, we also take note of the Government Order dated 02.04.2013 bearing No. 1118/XVII- 1/2013-01(20)/2013, issued by State of Uttarakhand, in this regard and the case of the present petitioner is covered by the said Government Order wherein at Paragraph No. 4 the following provisions have been made, which reads as under:-

5. In that view of the matter, the writ petition is allowed. The Tehsildar, Ram Nagar, District Nainital - respondent no. 3 is directed to reconsider the matter and after affording reasonable opportunity of hearing and producing the documents to the petitioner to establish her case, in terms of the provisions referred to above, shall take a decision strictly, in accordance with law, by speaking and reasoned order within a period of 21 days from production of certified copy of this order.
