Counsel for the respondent has raised the issue of maintainability of the present writ petition by submitting that the petitioner has a remedy under Section 17 of the SARFAESI Act. He placed reliance on the judgment of the Supreme Court in Agarwal Tracom Private Limited Vs Punjab National Bank and others, (2018) 1 SCC 626.

Counsel for the petitioner wishes to examine the said aspect.

Matter is adjourned to 14.02.2023. In the meantime, the respondent may file counter-affidavit within four weeks. Rejoinder be filed before the next date.
