Petitioner participated in a selection for the post of Forest Guard in which she claimed benefits of reservation for OBC women candidate.
In this writ petition, grievance raised by petitioner is that the last selected women candidate, in General category, scored less marks than the petitioner, therefore, petitioner should have been appointed against her. Reliance has been placed upon a judgment rendered by Hon'ble Supreme Court in the case of Saurav Yadav & others vs State of Uttar Pradesh & others, reported in (2021) 4 SCC 542.
Issue notice to respondent nos. 5 to 9 returnable within four weeks. Steps to be taken within 48 hours. List this case on 02.12.2022 showing the name of Mr. Lalit Samant, learned counsel for respondent no. 4.
In the meantime, respondent nos. 1 to 4 shall file counter affidavits.
It is made clear that appointment, if any already made, shall be subject to final outcome of present writ petition.
