Today the matter is listed on the Urgency Application No. 3 of 2022, preferred by the applicant.

The same would stand allowed.

The learned counsel for the applicant has filed IA No. 2 of 2022, thereof placing on record the copy of the judgment dated 24th March, 2022, as it was rendered in C482 Application No. 1075 of 2017, along with other two connection C482 Applications referred in the judgement, which too were arising out of the same FIR No. 205 of 2015.

Hence, the learned counsel for the applicant prays for, that the matter stands covered by the judgement of 24th March, 2022, and the same could be decided in terms of the said judgment, which is a fact not disputed by the Government Advocate.

After having heard the learned counsel for the applicant, including the Deputy A.G., the factum that the other co-accused, who have filed C482 Applications, their C482 Applications have already been allowed by the Coordinate Bench by the judgment of 24th March, 2022, the present C482 Application, since it engages the common consideration of facts and law, coupled with the fact that it is emanating from the same FIR No. 205 of 2015, as registered on 24th August, 2015, this C482 Application would too stand allowed in terms of the judgment dated 24th March, 2022, as rendered in C482 Application No. 1075 of 2017, Bachan Singh and others Vs. State of Uttarakhand and another.
